What philosophy you would like to see in BushÂ’s Nominee to replace Justice OÂ’Connor and why?
To me, that's a very easy question to answer. It's very simple, but I think the actual odds of it happening are very, very small.
I want a judge who will interpret the United States Constitution as it was written.
That's all. I don't want someone who is going to "find" things in the Constitution that were not there 20 years ago. I don't want someone who is going to use European standards in determining their decisions. I do not want someone who is going to use "evolving, living, societal" standards. I want someone who will very simply and very clearly interpret what was written. As James Wilson said ( one of the original justices on the Supreme Court):
The first and governing maxim in the interpretation of a statute is to discover the meaning of those who made it.
And just one more quote that shows why:
What a metamorphosis would be produced in the code of law if all it's ancient phraseology were to be taken in its modern sense.
-- James Madison
Then again, the Democrats will oppose whomever Bush nominates. He could nominate Teddy Kennedy, Bill Clinton, Hillary Clinton, or even Henry Reid and the Democrats would oppose them, simply because that's what they do.
